In these Terms and Conditions, **”Just Health”, “JH”, “we”, “us” and “our”** refer to Just Health.

Just Health provides a range of medical, occupational health and related services, which may include:
* Driver medical assessments;
* HGV/LGV and Group 2 driver medicals;
* Taxi and private-hire medicals;
* Firearms and shotgun licence medical reports;
* Occupational health assessments;
* Offshore and specialist occupational medicals;
* Private GP services;
* Visa and immigration-related medical assessments;
* Travel health and vaccination services;
* Other medical assessments and services offered through our website.
The services available may vary by location and are subject to availability.

## 2. SISTER COMPANIES, GROUP COMPANIES AND AUTHORISED PARTIES
Just Health may operate as part of, or work alongside, a wider group of businesses and may have **sister companies, associated companies, group companies, contractors, professional advisers, service providers or other authorised parties**.
Where appropriate and subject to applicable law, Just Health may appoint, authorise or permit such companies, organisations or third parties to act on our behalf or assist us in providing, administering or supporting our services.

* Managing business, financial or administrative functions; and
* Carrying out other functions reasonably required to provide or administer the services purchased from Just Health.
Where another company, group entity or authorised party acts on behalf of Just Health, it may do so as an authorised representative, service provider, contractor, agent or other appointed party, as appropriate.
Your contract for the relevant service remains with Just Health unless you are expressly informed otherwise at the time of booking or before the service is provided.
Where personal or medical information is involved, any sharing, access or processing will be carried out in accordance with applicable data protection law, confidentiality requirements and our Privacy Policy.
The involvement of a sister company, group company, associated entity, contractor or authorised third party does not affect your statutory rights or the professional obligations applicable to any healthcare professional involved in your care or assessment.

## 3. AGREEMENT BETWEEN YOU AND JUST HEALTH
These Terms and Conditions form the basis of the contract between you and Just Health.
Before submitting an order, booking or referral, you should read these Terms and Conditions carefully.
If you do not understand any part of these Terms and Conditions, please contact us for clarification before proceeding.
A legally binding contract will generally be formed when your booking, order or referral is accepted by us and, where applicable, payment has been successfully received.
We will endeavour to make relevant information available to you before the contract is formed. Where information is necessarily provided during the transaction or booking process, that information will also form part of the contractual arrangement where applicable.
These Terms and Conditions should be read together with any specific terms relating to the particular service you purchase, including any Retest Protection terms.

You should arrive at least **10 minutes before your scheduled appointment**, unless instructed otherwise.
Late arrival may reduce the time available for your assessment.
If you arrive too late for the assessment to be completed, we may be unable to proceed and the appointment may be treated as a missed appointment.
We will endeavour to keep appointments running on time. However, medical appointments can sometimes take longer than anticipated because of clinical circumstances, additional investigations, complex medical histories or other factors.

## 10. IDENTIFICATION AND DOCUMENTATION
For certain services, you may be required to provide suitable photographic identification or other documentation.
You may also be required to provide:
* Medical records;
* GP summaries;
* Specialist letters;
* Medication information;
* Investigation results;

* Licensing documentation; or
* Other supporting evidence.
Requirements vary according to the service.
If you do not provide information or documentation reasonably required to complete your assessment, we may be unable to complete the service.

## 11. YOUR MEDICAL INFORMATION AND RESPONSIBILITIES
You are responsible for providing complete, accurate and truthful information relevant to your assessment.
You must not deliberately withhold, alter or misrepresent relevant medical information.
Where applicable, you should disclose:
* Existing medical conditions;
* Previous medical conditions;
* Medication;
* Previous investigations;
* Relevant hospital treatment;
* Specialist involvement;
* Relevant mental or physical health conditions; and
* Other information reasonably requested as part of the assessment.
Failure to provide accurate information may result in:
* Delays;
* Additional information being requested;
* An assessment being unable to proceed;
* An adverse medical outcome;
* A requirement for further assessment; or
* Additional charges where additional work is required as a result.

## 12. MEDICAL RECORDS
Where a service requires access to medical records, you authorise Just Health, subject to applicable consent and legal requirements, to request and review relevant medical information for the purpose of providing the service.
Medical records may be reviewed by an appropriately qualified member of our medical panel.
Where records are incomplete or delayed, the assessment may be delayed.
You acknowledge that delays in obtaining records from your GP surgery, hospital or other healthcare provider may be outside our control.

## 13. CLINICAL INDEPENDENCE AND MEDICAL OUTCOMES
Our clinicians are required to exercise independent professional judgement.
Clinical decisions will be made based on the information available and applicable professional standards, guidance and requirements.
Payment for a medical assessment is payment for the assessment and professional service.
**Payment does not guarantee a particular medical outcome.**
We cannot guarantee that:
* You will be declared medically fit;
* You will pass an assessment;
* A medical certificate will be issued;
* A driving licence will be granted, retained or reinstated;
* A firearms certificate will be granted or retained;
* An employer will accept a medical opinion;
* A licensing authority will accept an assessment; or
* A regulator or government body will approve an application.
Where clinically or professionally necessary, a clinician may require further information, investigations, medical reports or specialist assessment.

## 14. MEDICAL PROFESSIONALS
We will endeavour to ensure that doctors undertaking medical assessments for Just Health:
* Hold appropriate professional registration;
* Have appropriate professional indemnity arrangements;
* Are suitably qualified for the service they undertake; and
* Have appropriate experience and competence for the relevant assessment.
Where appropriate, you may independently verify a doctor’s professional registration through the General Medical Council register.
Your referral or assessment may be allocated to an appropriately qualified member of the Just Health medical panel.
The doctor completing your assessment may therefore not necessarily be your own GP.

# 15. FIREARMS AND SHOTGUN MEDICAL REPORTS
Where you purchase a firearms or shotgun licence medical report through Just Health, the following additional terms apply.
By completing the referral and consent form and making payment, you are entering into a contract with Just Health for the provision of the relevant medical report service.
You must complete the referral and consent forms fully and accurately.
Referrals may be submitted through our online referral portal or using paperwork provided by Just Health.

## 16. FIREARMS MEDICAL REPORT TIMESCALES
You acknowledge that completion of a firearms medical report may take **up to 32 days** in circumstances where medical records and other information are required.
Our usual turnaround is substantially quicker.
Where GP or other medical records are required, delays may occur because the relevant healthcare provider can take time to supply the records.
Our target is to complete the report within approximately **72 hours from receipt of the required medical records**, where all other information necessary to complete the report is available.
The 72-hour target does not begin until the necessary medical records have been received.
Reports may sometimes be completed sooner or, depending on the circumstances, later than 72 hours.

## 17. FIREARMS MEDICAL RECORD REVIEW
Once the required medical records have been received, an appropriately qualified Just Health doctor may review them to determine whether there is evidence of relevant current or previous medical conditions.
Depending on applicable requirements, this may include consideration of:
* Acute stress reactions or acute reactions to stress caused by trauma;
* Depression or anxiety;
* Suicidal thoughts, intention or self-harm;
* Dementia;
* Mania;
* Bipolar disorder;
* Psychotic disorders;
* Personality disorders;
* Neurological conditions, including multiple sclerosis, Parkinson’s disease, Huntington’s disease or epilepsy;
* Alcohol misuse;
* Drug misuse; and
* Other mental or physical conditions that may be relevant to the safe possession of a firearm or shotgun.
This list is not exhaustive.
Relevant medical information may be shared with you and/or the relevant police force where appropriate and permitted or required.
The final decision regarding the grant, refusal, restriction or continuation of a firearms or shotgun certificate rests with the relevant licensing authority or police force.
Just Health does not guarantee the outcome of any firearms application.

## 18. FIREARMS GP MARKER
Applicable Home Office guidance may recommend that the applicant’s GP surgery is contacted to advise that the police may request a firearms marker be added to the applicant’s medical record where appropriate.
Where applicable, Just Health may communicate with the GP surgery regarding this process.
The purpose of such a marker is to assist with identifying relevant new medical information after a certificate has been granted, where the applicable arrangements permit or require this.

## 19. FIREARMS APPLICATION RESPONSIBILITIES
It is your responsibility to ensure that the relevant police force accepts a medical report completed by a doctor other than your own GP.
Just Health cannot guarantee that a particular police force will accept a particular report format or process.
You are responsible for ensuring that the information submitted on your referral form is complete and accurate.
If inaccurate or incomplete information results in additional work or the medical form having to be completed more than once, an additional charge may apply where reasonably justified.
You acknowledge that information contained in the medical report may be viewed by the relevant police force.

## 20. DRIVER MEDICALS AND LICENSING ASSESSMENTS
Where Just Health provides a driver medical or licensing-related medical assessment, the clinician will assess you against the applicable medical requirements.
The assessment does not guarantee that you will pass or that a licence will be issued.
The relevant licensing authority, including the DVLA where applicable, may make the final decision.
Just Health is not responsible for delays or decisions made by the licensing authority.
You are responsible for providing accurate information and any documentation required for the assessment.

## 21. OCCUPATIONAL HEALTH SERVICES
Where Just Health provides occupational health services, the assessment may provide an independent professional opinion regarding an individual’s health, functional ability, fitness for work or ability to undertake particular duties.
The occupational health opinion does not necessarily determine the employment decision.
Employment decisions remain the responsibility of the employer, subject to applicable law.

## 22. PRIVATE GP AND OTHER MEDICAL SERVICES
Where Just Health provides private GP or other clinical services, the clinician will assess and advise you based on the information available at the time.
No diagnosis, prescription, referral, treatment or particular clinical outcome is guaranteed.
Where appropriate, you may be advised to seek further assessment or treatment through NHS or other healthcare services.
Just Health’s services do not replace emergency medical care.

## 23. TRAVEL HEALTH AND VACCINATIONS
Travel health advice depends upon your destination, itinerary, medical history and current guidance.
You must provide accurate information regarding your travel plans and relevant medical history.
We cannot guarantee that a particular vaccination, medication or other intervention will be clinically appropriate or required.
Travel and entry requirements can change, and you remain responsible for checking the current requirements applicable to your journey.

## 24. COMMUNICATIONS
We may contact you by telephone, email, SMS, WhatsApp or other communication method that you provide or that is reasonably required to administer your booking.
Service-related communications may include:
* Booking confirmations;
* Appointment reminders;
* Requests for information;
* Requests for medical records;
* Updates regarding your assessment;
* Payment information;
* Results or reports; and
* Cancellation or rescheduling information.
Where applicable and subject to your preferences and applicable law, we may also send marketing communications.
You may opt out of marketing communications, but we may continue to send communications necessary to provide or administer a service.

## 25. FEEDBACK AND REVIEWS
We may invite customers to provide feedback or reviews.
Reviews should reflect your genuine experience.
You must not submit reviews that are knowingly false, misleading, fraudulent, threatening, defamatory or abusive.
Where permitted by law and applicable privacy requirements, feedback may be used to improve our services or for marketing purposes.

## 26. PRICE AND PAYMENT
The price for a service will normally be the price published on the Just Health website at the time of booking.
Prices may change from time to time.
Unless otherwise stated, payment may be required in advance.

For certain services, payment is taken when the referral or booking is submitted.
Where a service requires payment before a doctor begins work, the service will not normally commence until payment has been received.
Payment processing may be carried out by a third-party payment provider and may be subject to that provider’s terms.

## 27. CANCELLATION AND REFUNDS
If you wish to cancel a booking or referral, you should contact Just Health as soon as possible using the contact details provided on our website.
Cancellation rights may differ depending on the service and whether work has already commenced.
Where a doctor has not yet been allocated and medical work has not commenced, a full refund may generally be available, subject to any applicable service-specific terms.
Where a doctor has been allocated and has begun completing a medical report or assessment, a refund may not be available to the extent that professional work has already been undertaken.
Where a completed report has been returned to you or sent to the relevant authority or designated recipient, a refund may not be available.
Nothing in these Terms and Conditions excludes or limits statutory consumer rights that cannot lawfully be excluded.

## 28. MISSED APPOINTMENTS
An appointment may be treated as a missed appointment where you:
* Do not attend;
* Arrive too late for the assessment to be completed;
* Attend the wrong location;
* Fail to provide required documentation;
* Fail to provide required medical information; or
* Are otherwise unable to participate in the assessment for reasons within your control.
A missed appointment may be subject to a cancellation or rebooking charge.

## 29. RESCHEDULING
Where possible, we may allow you to reschedule an appointment.
Rescheduling is subject to availability and any applicable cancellation requirements.
We reserve the right to apply reasonable charges where an appointment is repeatedly rescheduled or where the applicable cancellation period has expired.

## 30. DELAYS OUTSIDE OUR CONTROL
We are not responsible for delays caused by circumstances outside our reasonable control.
Examples include:
* Delays in receiving medical records;
* GP surgery delays;
* Hospital delays;
* Specialist delays;
* Licensing authority delays;
* Police force delays;
* Third-party system failures;
* Technical problems;
* Telecommunications failures;
* Power failures;
* Severe weather;
* Transport disruption;
* Staff or clinician illness;
* Cybersecurity incidents;
* Government action; or
* Other events outside our reasonable control.
Where there is a substantial delay, we will endeavour to notify you and take reasonable steps to minimise the effect.
Where appropriate, you may be entitled to cancel and receive a refund for services that have not been provided.

## 31. IF WE CANNOT PROVIDE THE SERVICE
If, for any reason, Just Health is unable to provide a service or complete an assessment, we will endeavour to notify you as soon as reasonably possible.
Where appropriate, we may offer an alternative appointment or arrangement.
Where we are unable to provide the service and you are entitled to a refund, the refund will normally be limited to amounts paid for services that have not been provided, subject to applicable law.
Nothing in these Terms and Conditions excludes liability that cannot lawfully be excluded.

# 32. RETEST PROTECTION
### 32.1 What is Retest Protection?
Retest Protection is an optional add-on available with certain medical assessments.
It is designed to provide additional reassurance by allowing an eligible customer who does not pass their medical assessment because of a covered medical issue to receive **one re-test without paying the standard medical assessment fee again**.
Retest Protection must be purchased at the time of the original booking unless Just Health expressly agrees otherwise.
Retest Protection does not guarantee that you will pass your medical assessment.
### 32.2 What Retest Protection Covers
Where Retest Protection has been purchased and the eligibility requirements are satisfied, Just Health will provide one free re-test where the unsuccessful outcome relates to a qualifying covered medical issue.
Potential examples of covered reversible issues may include:
* An eyesight issue identified during the assessment;
* Raised blood pressure; or
* Another reversible medical issue that can reasonably be managed or addressed within the applicable re-test period.
The examples above are not exhaustive.
Eligibility will be determined by Just Health based on the circumstances of the original assessment and the terms applicable to the Retest Protection purchased.
### 32.3 Retest Period
The re-test should normally be completed within **28 days of the original medical assessment**, unless Just Health agrees otherwise.
The re-test is subject to appointment availability.
### 32.4 What Retest Protection Does Not Cover
Retest Protection does not:
* Guarantee that you will pass the re-test;
* Guarantee that a licence, certificate or approval will be issued;
* Provide a second opinion merely because you disagree with the original clinical decision;
* Cover a change of mind;
* Cover unrelated medical assessments;
* Cover additional investigations;
* Cover specialist assessments;
* Cover medical reports or medical records that may be required;
* Cover fees charged by third parties;
* Cover external diagnostic tests;
* Cover appointments missed or cancelled outside the applicable cancellation requirements;
* Cover failure to provide required medical information;
* Cover failure to provide required identification or documentation;
* Cover inaccurate, incomplete or misleading information supplied by you;
* Cover conditions or circumstances that were not disclosed when reasonably requested; or
* Provide more than one free re-test.
### 32.5 Medical Information
You must provide complete and accurate medical information.
Where additional medical records, reports, specialist letters, investigations or other evidence are required before a re-test, you are responsible for obtaining and providing that information.
Any third-party costs associated with obtaining such evidence remain your responsibility unless expressly stated otherwise.
### 32.6 Eligibility
Retest Protection does not mean that every unsuccessful medical assessment qualifies for a free re-test.
Just Health will determine eligibility based on:
* The original assessment;
* The reason for the unsuccessful outcome;
* The medical issue identified;
* The information supplied by the customer;
* Any relevant supporting evidence; and
* The applicable Retest Protection terms.
### 32.7 Re-test Appointment
The free re-test must be booked through Just Health.
The re-test is subject to availability and may not be available at the same location, date, time or with the same clinician.
You must attend the re-test at the agreed time and provide any documentation or evidence requested.
### 32.8 Missed or Cancelled Re-tests
If you fail to attend a re-test without providing the required notice, your Retest Protection entitlement may be treated as having been used.
If you cancel or reschedule a re-test, the normal cancellation and appointment requirements may apply.
Just Health may, at its discretion, allow a further appointment where exceptional circumstances exist.
### 32.9 No Cash Alternative
Retest Protection provides an entitlement to a qualifying re-test only.
It does not have a cash value and cannot normally be exchanged for a refund or other service.

# 33. PROFESSIONAL AND CLINICAL LIABILITY
Our clinicians are responsible for exercising appropriate professional judgement when providing clinical services.
Nothing in these Terms and Conditions is intended to exclude or limit liability for:
* Death or personal injury caused by negligence;
* Fraud or fraudulent misrepresentation;
* Breach of statutory rights;
* Professional negligence where liability cannot lawfully be excluded or limited; or
* Any other liability that cannot legally be excluded or limited.
Subject to the above, and to the extent permitted by law, where Just Health is unable to provide a service, our liability will generally be limited to the amount paid for the service that was not provided.

# 34. CONSEQUENTIAL AND BUSINESS LOSSES
To the extent permitted by law, where you use our services for a commercial or business purpose, we will not be responsible for:
* Loss of profit;
* Loss of business;
* Business interruption;
* Loss of business opportunity;
* Loss of anticipated savings;
* Third-party losses; or
* Other indirect or consequential losses.
Nothing in this section affects any liability that cannot lawfully be excluded or limited.

Just Health is not responsible for decisions made by third parties, including:

* Police forces;
* Licensing authorities;

We cannot guarantee that a third party will accept our medical assessment, report or recommendation.

# 36. CUSTOMER CONTACT WITH CLINICIANS AND STAFF
For administrative, safeguarding, clinical governance and professional reasons, customers should communicate with Just Health through the official contact channels provided on our website.
You must not attempt to circumvent Just Health’s booking or referral arrangements for the purpose of directly engaging one of our doctors or employees for services that are ordinarily provided through Just Health.
Nothing in this provision prevents you from exercising any legitimate legal, regulatory or professional right.

All intellectual property rights in the Just Health website and its content, including:

* Branding;

Where appropriate, we will provide information regarding the relevant complaints process and any applicable external organisation.
Nothing in this section prevents you from exercising any statutory or regulatory rights.

# 45. CHANGES TO SERVICES
We reserve the right to change, suspend or withdraw services where reasonably necessary.
This may include changes to:

* Clinicians;
* Appointment availability;

* Services;
* Booking systems; or

Where you have already paid for a service that we are unable to provide, we will endeavour to offer an appropriate alternative or refund where applicable.

# 46. CANCELLATION BY JUST HEALTH
If we need to cancel a booking or referral, we will endeavour to notify you as soon as reasonably possible.
Where we are unable to provide the service and no suitable alternative is agreed, you will normally be entitled to a refund of amounts paid for services that have not been provided, subject to applicable law.
Where professional work has already been completed, the amount refundable may depend on the work already undertaken and the applicable terms.

# 47. EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be liable for failure or delay caused by circumstances beyond our reasonable control.
Such circumstances may include:
* Severe weather;
* Natural disasters;
* Epidemics or pandemics;

* Transport disruption;
* Power failure;
* Telecommunications failure;
* Cybersecurity incidents;
* Government action;
* Clinician illness;
* Third-party service failures; or
* Other circumstances beyond our reasonable control.

# 48. NO WAIVER
If we do not immediately enforce any right or provision of these Terms and Conditions, this does not mean that we have waived that right.

# 49. SEVERABILITY

If a court or competent authority determines that any provision is unlawful, invalid or unenforceable, that provision will be interpreted or removed to the minimum extent necessary.

# 50. THIRD-PARTY RIGHTS
Unless expressly stated otherwise, this contract is between you and Just Health.
No person other than the parties to the contract shall have the right to enforce any of its terms under the **Contracts (Rights of Third Parties) Act 1999**.

form the agreement between you and Just Health in relation to the relevant service.
If there is a conflict between these general Terms and Conditions and specific terms expressly provided for a particular service, the specific service terms will generally take precedence for that service.
